O regime jurídico do teletrabalho subordinado, consagrado pela primeira vez no nosso ordenamento há mais de 20 anos, tem sofrido inúmeras alterações. As duas últimas foram introduzidas pela Lei n.º 83/2021, de 6 de dezembro (impulsionada pela Pandemia Global de 2020) e pela Lei n.º 13/2023, de 3 de abril (no âmbito da Agenda do Trabalho Digno).
Este artigo procura identificar e analisar algumas das questões mais ambíguas deste regime jurídico, que criam desafios para o intérprete e para os sujeitos das relações laborais individuais. Pretendemos contribuir para o debate, mediante uma análise crítica,
ambicionando “iluminar” alguns daqueles enigmas.
The legal framework for subordinate teleworking, first established in our legal order more than 20 years ago, has undergone numerous changes. The last two were introduced by Law 83/2021 of 6 December (triggered by the 2020 Global Pandemic) and by Law 13/2023 of 3 April (as part of the Decent Work Agenda). This article aims to identify and analyse some of the most ambiguous issues in this legal framework, which create challenges for the interpreter and for the parties of individual labour relations. We intend to contribute to the debate, through a critical analysis, aiming to ‘illuminate’ some of those enigmas.
