A gestão contratual é fundamental no desempenho das empresas. No caso do setor de construção, pela sua especificidade, a gestão contratual assume uma relevância particular. A forma como se efetua o acompanhamento da execução de um contrato pode ser determinante para sustentabilidade econômica e financeira das empresas. De entre os documentos do contrato, o Programa de Trabalhos constitui uma das peças fundamentais em que assenta a proposta de preço formulada pelo empreiteiro. Uma programação eficiente permite um acompanhamento e controlo do processo dos trabalhos, o que é importante para o controlo econômico e de prazos das empreitadas. Este trabalho foi proposto para analisar a relevância do Programa de Trabalhos na fase da gestão contratual de empreita- das, visando analisar os impactos desse Programa no processo de execução dos trabalhos e, consequentemente, no controlo econômico e de prazos durante a execução da obra. A realização do estudo se deu através da revisão bibliográfica acerca dos assuntos relaciona- dos ao tema e do desenvolvimento de um inquérito junto de representantes das empresas do setor de construção. Com os dados recolhidos no inquérito foi possível uma análise estatística da amostra escolhida e a retirada de conclusões. Feita a revisão bibliográfica e com as repostas dos inquiridos, conclui-se que uma execução deficiente do Programa de Trabalhos, que faz parte da atividade de planeamento tem um impacto direto e muito significativo nos principais problemas que afetam hoje a indústria da construção: incumprimento de prazos e do orçamento e trabalhos adicionais.
An efficient contractual management is of paramount importance in the activities of enterprises. With regard to the construction sector, owing to its specificities, contractual management is one of the primordial activities that affect the performance of the enterprises. The way the monitoring and control of the construction works are made might determine the economic and financial sustainability, an even survival of the construction enterprises. Amongst the contract data, The Program ofWorks constitutes a fundamental document that informs the tender price formulated by the contractor. An efficient pro- gramme of works allows the monitoring and control of the construction work processes, and the ensuing time and cost management. The purpose of this study is to analyse the relevance of the Programme of works in the process of construction works and, consequently, the impact an efficient programme has on time and cost control during the execution phase. The study involves a literature review of the legal framework of the construction in- dustry in Portugal and Brazil as well as of the programmatic areas that ultimately inform the contractual aspects of of the construction works during the execution phase. Addi- tionally, a questionnaire-survey was conducted on the representatives of the construction enterprises in the Bragança district, Portugal, who are knowledgeable of construction industry contracts promoted by the public sector. The analyses of the literature review and the results of the questionnaire-survey suggest that deficiencies of the Programme of Works have a direct and significant impact on the main problems and constraints that affect the construction industry market: time and cost overruns, and problems derived from contractual modifications.
