Este trabalho de investigação tem como propósito questionar se a boa relação, exigida por lei, entre executivos e oposições autárquicas correspondem a uma realidade ou a uma utopia. Trata-se de uma temática onde têm ocorrido progressos significativos em termos legislativos, nomeadamente com a publicação do importante instrumento do Estatuto do Direito de Oposição. Não obstante, não constitui surpresa, por tantos e variados casos, que uma legislação adequada e progressista acabe por ter como resultado indesejável uma falta de adesão à realidade, porquanto, não-raro, a prática é minada de resistências e de procedimentos rotineiros, acabando a oposição por ver os seus efeitos mitigados. Essa potencial divergência é um dos assuntos a que se não deixará de penhorar cuidada atenção, justamente com o objetivo de, ao longo deste estudo, verificar para que lado da balança pende o maior peso de dois vetores utilizados no título desta dissertação: utopia ou realidade, no que concerne ao respeito ou ao desrespeito pela oposição no quadro das instituições municipais e, sobremaneira, colocando o enfoque sobre os eleitos das Assembleias Municipais, as quais são, afinal, o palco por excelência do exercício da oposição relativamente ao executivo concentrado no órgão da Câmara Municipal. Esta, no caso de ser eleita com maioria absoluta, faz perigar as oposições de maneira mais veemente e os direitos que assistem à oposição são mitigados com maior frequência. Os resultados obtidos nesta dissertação apontam mais para uma utopia do que para uma realidade, porquanto muito há ainda a fazer para que as oposições beneficiem do respeito dos executivos de que são, juridicamente, credoras em nome de valores fulcrais como: transparência, democraticidade, imparcialidade.
The purpose of this research paper is to question whether the good relationship, required by law, between municipal executives and oppositions is a reality or a utopia. This is a theme in which significant progress has been made in legislative terms, particularly with the publication of the important instrument of the Statute on the Right of Opposition. Nevertheless, it comes as no surprise, given the many and varied cases in which adequate and progressive legislation ends up having, as an undesirable result, a lack of adherence to reality, because, not infrequently, practice is plagued by resistance and routine procedures, and the opposition ends up seeing its effects mitigated. This potential divergence is one of the subjects to which we will pay careful attention, precisely with the purpose of, throughout this study, verifying on which side of the scale hangs the greater weight of the two vectors used in the title of this dissertation: utopia or reality, regarding the respect or disrespect for the opposition in the framework of municipal institutions and, above all, focusing on the elected members of the Municipal Assemblies, which are, after all, the stage par excellence for the exercise of the opposition to the executive concentrated in the body of the Municipal Council. The latter, when elected with an absolute majority, endangers the opposition more vehemently and the rights of the opposition are more often mitigated. The results obtained in this dissertation point more to a utopia than to a reality, since much remains to be done for the oppositions to benefit from the respect of the executives to which they are legally credited in the name of core values such as transparency, democracy, and impartiality.
