| The proposed Directive on Corporate Sustainability Due Diligence stands as a significant milestone in the safeguarding of human rights and the environment. The ongoing legislative process within European Union has given rise to new considerations regarding the methods of risk mitigation that companies, under the scope of the future Directive, will adopt. Among the risk management methods currently under discussion is the use of contracts between companies and their partners, with a notable emphasis on bilateral contracts. In this article, we delve into the introduction of corporate liability for damages and its interaction with contracts as a means of risk management. However, we propose an approach that extends beyond bilateral contracts, advocating for the consideration of multilateral contracts.
