| dc.description.abstract | The increasing digitization of labor relations has resulted in the increased use of technological control mechanisms in the workplace, posing new challenges to the delimitation of employer powers and the protection of workers' fundamental rights. Digital monitoring at work is currently taking on increasingly complex forms, based on the collection and processing of personal data. This study analyzes the legal limits of digital monitoring in the workplace, observing the extent to which the use of surveillance technologies is compatible with the protection of workers' fundamental rights, namely the right to privacy at work and the protection of personal data. The main objective of this research is to determine the extent to which digital monitoring is legally admissible and the criteria that should guide its use, ensuring a balance between the employer's organizational interests and the rights to privacy, personal data protection, and dignity of the worker, while also demonstrating the limits to the power of control. Methodologically, this study is based on a dogmatic legal approach, grounded in a systematic analysis of national legislation, European Union law, with a particular focus on the General Data Protection Regulation (GDPR), as well as relevant case law and doctrine. The results allow us to conclude that digital monitoring is legally permissible, but subject to strict material and procedural limits. In this sense, this study highlights the need for strict application of legal principles, especially in view of the growing sophistication of digital monitoring mechanisms, whose expansion tends to intensify the challenges already identified.
