A captura de som e imagem (gravação e transmissão vídeo) das sessões das assembleias
municipais, não se encontra prevista na Lei n.º 75/2013, de 12 de Setembro, na sua redação
atual, nem no Código de Processos Administrativo e o facto de estarmos perante dados
pessoais, a sua recolha e divulgação pode ser um assunto de legalidade controversa, face
ao previsto nos n.º 1 e 2 do artigo 9.º do Regulamento Geral sobre a Proteção de Dados, já
que a sua divulgação pode afetar, além dos direitos à imagem, o direito à proteção de dados
pessoais e até o direito à reserva da intimidade da vida privada, à luz dos artigos 26.º e 35º
da Constituição da República Portuguesa. Neste sentido, esta dissertação pretende obter
resposta para a seguinte questão: Quais as práticas das assembleias municipais em termos
de transmissão online e como resolvem ou garantem a proteção de dados pessoais? Para
dar resposta à questão supracitada, o estudo pauta-se em perceber a forma como as
assembleias municipais estão a implementar o Regulamento Geral sobre a Proteção de
Dados relativamente ao tratamento de dados pessoais. Pretende-se através da resposta à
pergunta de investigação contribuir para que as assembleias municipais consigam abarcar
qual é a melhor forma de enquadrar a matéria relativamente aos dados pessoais. Sendo
que se optou por uma abordagem qualitativa, com a estratégia de investigação
interpretativa. Quanto à recolha de dados, optou-se pela utilização de uma análise aos 308
municípios portugueses de modo a perceber a adesão às transmissões online e a forma
como as assembleias municipais acautelam os dados pessoais dos eleitores. Os dados
recolhidos e analisados permitem concluir que as assembleias municipais têm vindo a aderir
a esta temática, muito impulsionado pela pandemia de COVID-19, mas um elevado número
de regimentos não fazem referência à proteção de dados pessoais e outros tentam colmatar
a lacuna legal existente de diversas formas, regimentos e regulamentos próprios ou até com
formulários a serem preenchidos pelo titular, autorizando ou não a divulgação da filmagem
e a transmissão áudio/vídeo da sua imagem e intervenção.
The capture of sound and image (recording and video transmission) of municipal assembly sessions is not provided for in Law no 75/2013, of September 12, in its current wording, nor in the Code of Administrative Procedure (CPA) and the fact that we are dealing with personal data, its collection and disclosure may be a matter of controversial legality, given the provisions of paragraphs 1 and 2 of the General Data Protection Regulation (GDPR). In addition to image rights, the disclosure of personal data can affect the right to protection of personal data and even the right to privacy, in the light of Articles 26 and 35 of the Constitution of the Portuguese Republic (CRP). In this sense, this dissertation aims to answer the following question: What are the practices of municipal assemblies in terms of online transmission, and how do they resolve or guarantee the protection of personal data? To answer the above question, the study aims to understand how municipal assemblies implement the GDPR to process personal data. By answering the research question, the aim is to help municipal assemblies understand the best way to deal with personal data. A qualitative approach was chosen, using an interpretive research strategy. Regarding data collection, the decision was made to analyse the 308 Portuguese municipalities to understand their adhesion to online transmissions and how municipal assemblies protect voters' data. The data collected and analysed allows us to conclude that municipal bodies have been adhering to this theme, much driven by the covid.19 pandemic, but many bylaws do not refer to protecting personal data. Others try to fill the existing legal gap in various ways, bylaws, and regulations or even with forms to be filled out by the holder, authorising or not the dissemination of the footage and the audio/video transmission of their image and intervention.
